Terms of Service

These Terms of Service (the "Terms") govern your access to and use of the WEITBLICKA platform, including any services, applications, APIs, and content (collectively, the "Service") provided by WEITBLICKA ("WEITBLICKA", "we", "us", or "our").

1. Acceptance of Terms

By creating an account, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service. If you are agreeing on behalf of an organization, you represent that you have authority to bind that organization.

2. Description of Service

WEITBLICKA provides data analysis, insight, and platform services, including the NOSKA suite for backtesting, pattern matching, and market screening. The features available to you depend on your selected plan and may evolve over time.

3. Account Registration

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account.
  • One account is permitted per natural person. Account sharing is not allowed.
  • You must be at least 16 years old to use the Service.

4. Subscription Plans and Billing

WEITBLICKA offers tiered plans, including Essential, Pro, and Enterprise (availability of Enterprise may be limited at launch). Pro includes a 14-day free trial. Payment is processed by third-party payment providers; by subscribing you also agree to those providers' terms.

Subscriptions auto-renew at the end of each billing period unless canceled. Annual plans canceled within 14 days of purchase are eligible for a pro-rated refund of the unused portion. Monthly plans are non-refundable but may be canceled at any time and will not renew thereafter.

5. Acceptable Use

  • No scraping, automated mass extraction, or denial-of-service-like usage.
  • No resale or redistribution of WEITBLICKA-provided data without a separate written agreement.
  • No illegal, infringing, harmful, or deceptive use of the Service.
  • API usage is subject to rate limits; abusive patterns may be throttled or blocked.

6. Intellectual Property

WEITBLICKA and its licensors retain all right, title, and interest in and to the Service, including all software, models, designs, and brand assets. You retain rights to the content, queries, and data you submit ("User Content"), and grant WEITBLICKA a worldwide, non-exclusive license to process User Content solely as necessary to provide and improve the Service.

7. Termination

You may terminate your account at any time. We may suspend or terminate your access for violation of these Terms, suspected fraud, security risk, or non-payment. Sections that by their nature should survive termination will survive (including IP, disclaimers, liability limits, and governing law).

8. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, or accuracy of data.

WEITBLICKA does not provide investment advice, trading signals, or financial recommendations of any kind. NOSKA outputs are statistical analyses of historical market data only — they are not recommendations to buy, sell, or hold any security or financial instrument. Past performance displayed in NOSKA does not guarantee or imply future results. Users are solely responsible for their own trading and investment decisions. These outputs are provided for informational and research purposes only.

9. Limitation of Liability

To the maximum extent permitted by law, WEITBLICKA's aggregate liability for any claim arising out of or related to the Service is limited to the fees you paid to WEITBLICKA for the Service in the twelve (12) months preceding the event giving rise to the claim. WEITBLICKA is not liable for indirect, incidental, special, consequential, or punitive damages.

10. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or in-product notice at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of [Jurisdiction TBD — to be set by company counsel], without regard to conflict-of-laws principles. The courts located in that jurisdiction will have exclusive jurisdiction over any disputes, except where mandatory consumer-law provisions apply.
